Before using the Retro Freak, please be sure to read the terms and conditions of the License Agreement (the "Terms and Conditions ") listed below.
If you press the "Accept" button as to the Terms and Conditions, a License Agreement will be created between you (the "User") and Cyber Gadget Corp. (the "Company") as to the Retro Freak product (the "Product") based on the Terms and Conditions.
If you cannot agree to the Terms and Conditions, please contact the Company's User Support Department, without pressing the "Accept" button. In such case, the Company will refund the price you paid for the Product, after you provide the Company with the Product and a purchase receipt. However, this refund option is only available for 30 days after your purchase of the Product (based on the date on the purchase receipt). Please understand that, after the expiration of the 30 day period, this refund option will not be available.

Terms and Conditions of License Agreement
Article 1. Copyright
All copyright rights in the Product shall be owned by the Company; provided, however, that all copyright rights in the emulation software and operating system software (e.g. Android, Linux) contained in the Product shall be governed by the license agreements for such software.
The copyright rights for games played using the Product shall be owned by the original creator of the game.
Article 2. Prohibited Acts as to Product
The User is prohibited from engaging in the following acts in connection with use of the Product: provided, however, that use of the emulation software and operating system software (e.g. Android, Linux) contained in the Product shall also be subject to any prohibitions contained in the license agreements for such software:
·copying all or a part of the Product
·reverse engineering or disassembly of the Product or any similar act
·altering, changing, or modifying the Product or any similar act
·incorporating all or part of the Product into any other product
Article 3. Prohibited Acts as to Games
(1) If the User installs a game in a media (microSD card) and plays such game using the Product, such use of the Product shall be strictly limited to game cards and game cartridges owned by the User. If the User plays a game using the Product and does not own the game card or game cartridge, the User shall not install the game in a media (microSD card).
(2) The User is strictly prohibited from selling, loaning, or transferring to a third party (i) any media (microSD card) in which a game is installed or (ii) the Product together with any media (microSD card) in which a game is installed. Any copying of a game for purposes other than personal use may subject the User to criminal or civil liability as a violation of copyright law.
(3) If the User installs a game from a game card or game cartridge that they own into a media (microSD card), and thereafter sells, loans, or transfers such game card or game cartridge to a third party, the User shall delete the game from such media (microSD card).
(4) The User may use the Cheats features in the Product only to play games owned by the User. If the data for a game owed by the User has been altered by the Product, the User shall not sell, loan, or transfer the game to a third party. If a game is installed in a media (microSD card), then, as stated in paragraph (2) above, the User shall not sell, loan, or transfer the media (microSD card) to a third party, regardless of whether such game includes Cheats features.
(5) If the User uploads to an Internet website a video, still image, or other content of the User playing a game using the Product, the User shall strictly comply with any applicable guidelines, etc. issued by the copyright owner of the game.
(6) In addition to the above, the User shall not engage in any act that infringes on any copyright relating to the game.
Article 4. No Warranty
No warranty is made that the actions, video, and audio of a game played using the Product will be reproduced with 100% accuracy, even if the game is for a console for which the Product is stated to be compatible. Also, there may be cases where a game played using the Product does not play at all or plays very differently from the original game.
Article 5. Release of Liability
The Company shall not be liable for any direct, indirect, derivative, or any other type of damages that result from the User's use of the Product.
Article 6. Breach of Terms and Conditions
If the User breaches any of these Terms and Conditions, the Company shall have the right to terminate this Agreement. In such case, the User shall completely destroy the Product and provide the Company with proof of the destruction. In addition, if the Company suffers any damages as a result of the User's breach, the User shall compensate the Company for such damages.
Article 7. Amendment of Terms and Conditions
(1) The Company shall have the right to unilaterally amend these Terms and Conditions, as it deems necessary in its sole discretion, upon prior notice to the User. The Company may give such notice to the User by displaying the amended Terms and Conditions on its webpage. The amendments shall become effective as of the date of such notice.
(2) If new versions of the Product became available, the User may update the Product by downloading the updates from the Company's webpage. In such case, the User may be required to again agree to these Terms and Conditions (or an amended version, if these Terms and Conditions have been amended) as a condition to using the new version of the Product. If the User does not agree to the Terms and Conditions, they will be prohibited from further use of the Product.
(3) There may be times when the User is requested to completely delete and re-install game(s) that the User has installed in a media (microSD card), due to updates of the Product or other reasons. In such case, the User shall follow the instructions of the Company.
Article 8. Court Jurisdiction
The Tokyo District Court and/or Tokyo Summary Court shall have exclusive jurisdiction, as the court of first instance, over any dispute arising from this Agreement.
